NEW ORLEANS – A man who had a knee replacement is seeking damages from the manufacturer claiming the implant was defective.
Thorf Michael Anderson filed a suit and short form complaint Feb. 4 in the U.S. District Court for the Eastern District of Louisiana against Zimmer Inc., Zimmer Holdings Inc. and Zimmer Orthopaedic Surgical Products Inc. over an allegedly defective knee replacement.
The plaintiff filed this short form complaint and suit in regards to the Zimmer NexGen Knee Implant Products Liability Litigation, MDL 2272, filed as of Jan. 12, 2012. He alleges to have been implanted with a Zimmer NexGen Knee device on his left knee on or about Sept. 12, 2011, at North Oaks Medical Center, by Dr. Brett J. Chiasson. As a result of the purportedly defective implant, plaintiff asserts that he suffered injuries and economic strife and had to have revision surgery on Nov. 16, 2015. He claims that the defendants were negligent in their actions, breached several warranties and were unjustly enriched.
He is seeking compensatory, punitive or exemplary and applicable statutory damages; attorney fees and costs; cost of suit; interests; and any further relief deemed just by the court.
