NuVasive Forever Barred From Using NEUROVISION Trademark

Los Angeles, September 5, 2014 –

A Los Angeles federal judge issued a permanent injunction earlier this week against NuVasive, Inc. (NUVA), forever barring the medical device manufacturer from using the trademark NEUROVISION to promote or sell medical devices in the United States.

The injunction follows a verdict earlier this year in which a jury found that Ventura, California-based Neurovision Medical Products, Inc. is the rightful owner of the NEUROVISION trademark and that NuVasive had been willfully infringing upon Neurovision Medical’s trademark rights. The jury also found clear and convincing evidence that NuVasive had defrauded the United States Patent and Trademark Office by registering the NEUROVISION mark for itself despite knowing of Neurovision Medical’s superior rights in the mark. The jury awarded $30 million.

Following the verdict, the judge denied NuVasive’s post-trial motions and granted an injunction. In the judge’s written decision granting the injunction, she found that Neurovision Medical “would suffer irreparable harm absent an injunction” and added that she “has no confidence that in the absence of an injunction, [NuVasive] will stop using the mark.”
